  Tomb of Joseph Dutton, Cote Graveyard In affectionate remembrance of Joseph Dutton of Standlake, who died June 3rd 1872, aged 86 years. Deacon of Cote Baptist Church ofr 50 years. "Ready for every good work" Also, his four children: Joseph, died 1819 aged 3 months Susanna Clara, died 1842 aged 25 years Hannah Maria, died 1842 ages 30 years Henry John died 1846 aged 31 years Joseph Dutton This is the last Will and Testament of me Joseph Dutton of Standlake in the County of Oxford Gentleman made this Fourth day of October One thousand eight hundred and seventy as follows I give the sum of Ten pounds amongst such of the poor members of the Baptist Church at Cote as the present Minister the Reverend Benjamin Arthur or the Minister for the time being in case the said Benjamin Arthur shall not be Minister shall indicate such legacy to be paid out of such part of my personal Estate as is applicable by law to charitable bequests All the remainder of my personal estate I give to my Friends Gabriel Long of Aston in the County of Oxford Grocer and Carpenter and Charles Clack of Aston aforesaid Farmer and Grocer Upon trust to give my Brother John now living in Oxford all my wearing apparel and to Samuel Richard Son of my Sister Ann Dutton my silver Watch and appendages and then to convert all the residue into money and stand possessed thereof for the purposes hereinafter mentioned As to all my real estate and chattels real I give the same to the said Gabriel Long and Charles Clack To hold to them their heirs executors administrators and assigns according to the tenures thereof Upon trust to make sale thereof either together or in parcels and by public auction or private contract at one or several times with power to buy in rescind or alter any contract for sale thereof and resell the same and to make and execute all necessary conveyances and assurances to the purchaser or purchasers thereof and stand possessed of the money to arise from such sale or sales together with the money to arise from the conversion of my personal estate Upon trust in the first place to pay the expences in attending such sale and conversion and all my just debts (including mortgage debts) funeral and testamentary expences then to retain Five pounds each to each of themselves my said Executors as a mark of my esteem then to pay Twenty pounds free of legacy duty to my said Sister Ann Dutton Five pounds to the said Reverend Benjamin Arthur Fifteen pounds to my Servant Ellen Smith And I direct my Executors to erect at the Baptist Chapel or Church at Cote aforesaid a suitable Tomb with a neat inscription to the memory of myself and children at a cost not exceeding in all the sum of Twenty pounds and the residue I give to my Sister Martha the Wife of Job Green If there should not be sufficient to pay all the aforesaid legacies in full then the whole of them except the legacy to the members of the Cote Church shall abate in proportion I appoint the said Gabriel Long and Charles Clack joint Executors of this my Will I declare that the receipt and receipts of my said Trustees for any moneys payable to them under this my Will shall be sufficient discharge and discharges to any person or persons having to pay the same and that such person or persons shall not afterwards be answerable or accountable for the loss misapplication or nonapplication of the money in such receipt or receipts acknowledged to be received and that my said Trustees shall not be answerable the one for the other of them but each of them for himself only nor for any misfortune loss or damage to the said trust premises but each of them for his own wilful defaults only In witness whereof I the said Joseph Dutton have to this my last Will and Testament set my hand the day and year first before written Signed by the said Testator as and for his last Will and Testament in the joint presence of us present at the same Joseph Dutton time who at his request in his presence and in the presence of each other have hereunto subscribed our names as Witnesses H J Skinner Solicitor Bampton Oxon F A Hieatt his Clerk (Transcribed from Office Copy) Solicitor's name is given as Harry John Skinner Also in the last fortnight, I think I have been able to confirm that William's wives, Ann and Mary Dutton, were sisters. Their brother Joseph (bapt 1786, son of Joseph Dutton and Elizabeth Lardner) left a will proved 1872, which confirms that he was brother of Ann, and baptism records confirm that Joseph and Mary were sisters. In his will, Joseph leaves his watch to "Samuel Richard son of my sister Ann Dutton", and he also mentions his "brother John now living in Oxford", his "said sister Ann Dutton" and his "sister Martha the wife of Job Green". This will was proved in Oxford, so they may have a copy in the Oxfordshire RO, though being a post-1858 will, you probably won't be allowed to take a copy of it there.
